We're learning the first sicha on parshas shoftim in chelek lamed daled on page 98. The shiur today is being learned by l'nishmas Rav Yosef ben Yamin ben Rav Nachman Kaltmann. We finish Rashi reish parshas seino. In Rashi in the beginning of this week's parsha, shoftim v'shotrim. The pasuk says to appoint judges and police. Shoftim, dayanim mafsikim misadin. Shoftim are the judges that give out the ruling. V'shotrim, hareiden es ha'am, they are V'shotrim, hareiden es ha'am, they are the ones that subjugate the people acham itzvasam to follow to fulfill the command that the beis din ruled. Sh'makin v'chaifin, they may hit or also bind b'makol u'v'retzua with a stick or a whip achi kabala lav is dein ashaifit until the person accepts the judgement the the verdict of the judge. K'chasuv b'mefarshim, so the commentaries explain, the masa the masha haisef Rashi, fact that Rashi adds and explains sh'shoftim that Rashi adds and explains sh'shoftim hein dayanim mafsikim misadin, that shoftim means those that are judging and give out the ruling. Af al gab d'yeduah sh'kol dayanim pasikim sadin. Everyone knows that that's what the shaifit is, the judge that gives the ruling. Why is Rashi explaining this point? K'dei l'vayeil ha, because Rashi comes to explain lama hotzach l'eima oy shotrim, why is the pasuk adding that the mitzvah includes shotrim as well?
